Terms & Conditions – ph794 Platform Agreement

1. Acceptance of Terms

• Winnings from duplicate accounts will be forfeited

7.2 Account Suspension and Termination

ph794 reserves the right to suspend, restrict, or permanently terminate your account at any time, with or without prior notice, if we determine that you have violated these Terms, engaged in fraudulent activity, or for any other reason at the Company's sole discretion. Upon termination:

• Your access to the Platform will be immediately revoked
• All pending bets may be voided
• Bonus funds and promotional winnings will be forfeited
• Original deposits may be returned, minus any applicable fees or chargebacks

7.3 Voluntary Account Closure

TO THE FULLEST EXTENT PERMISSIBLE UNDER APPLICABLE LAW, PH794 DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

ph794 does not warrant that the Platform will operate error-free, that defects will be corrected, or that the Platform or servers are free from viruses or other harmful components. We do not guarantee uninterrupted access to the Platform or any specific game availability.

9.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PH794 SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, PUNITIVE, OR EXEMPLARY DAMAGES ARISING FROM YOUR USE OF THE PLATFORM, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF DATA, OR LOSS OF BUSINESS OPPORTUNITIES, EVEN IF PH794 HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

In jurisdictions that do not allow the exclusion or limitation of liability for consequential or incidental damages, ph794's total liability shall be limited to the amount you deposited into your account in the six (6) months preceding the event giving rise to the claim, or PHP 10,000, whichever is less.

9.3 Indemnification

You agree to indemnify, defend, and hold harmless ph794, its parent companies, subsidiaries, affiliates, officers, directors, employees, agents, licensors, and suppliers from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from: (a) your violation of these Terms; (b) your violation of any applicable law or regulation; (c) your violation of any third-party rights; or (d) any fraudulent or malicious activity conducted through your account.

10. Dispute Resolution and Governing Law

10.1 Governing Law and Jurisdiction

These Terms and Conditions shall be governed by and construed in accordance with the laws of the Republic of the Philippines, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms or your use of the ph794 Platform shall be subject to the exclusive jurisdiction of the courts located in Metro Manila, Philippines.

10.2 Dispute Resolution Process

10.3 Class Action Waiver

You agree that any dispute resolution proceedings, whether in arbitration or court, will be conducted only on an individual basis and not in a class, consolidated, or representative action. 10.4 Time Limitation on Claims

Any claim or cause of action arising out of or related to your use of ph794 must be filed within one (1) year after the claim or cause of action arose, or such claim shall be permanently barred. This limitation period applies to all claims regardless of their legal theory.
